The Racker – Terms and Conditions of Sale

1. Introduction

1.1 These terms and conditions govern the sale of products through our website.

1.2 By placing an order through our website, you confirm that you agree to these terms and conditions.

1.3 These terms do not affect your statutory rights under UK consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

  • “you” refers to the customer placing the order


2. Ordering Process

2.1 Products displayed on our website constitute an invitation to purchase and not a binding offer.

2.2 A contract between you and us is formed only once we send an order confirmation.

2.3 The ordering process includes the following steps:

  • selecting products and adding them to the cart

  • entering delivery details

  • confirming agreement to these terms

  • completing payment through our payment provider

2.4 You will have the opportunity to review and correct errors before placing your order.


3. Products

3.1 We may update or discontinue products at any time.

3.2 Product descriptions and images are provided for illustration purposes. Minor variations may occur.


4. Prices

4.1 All prices are displayed on our website.

4.2 Prices may change at any time but will not affect orders already confirmed.

4.3 Prices are shown exclusive of VAT unless stated otherwise.

4.4 Delivery charges will be shown during checkout before payment is made.

4.5 In the unlikely event of a pricing error, we reserve the right to cancel the order and issue a refund.


5. Payment

5.1 Payment must be made in full at the time of ordering.

5.2 Accepted payment methods are those listed on our website.

5.3 If a payment is reversed through a chargeback without justification, we reserve the right to recover:

  • the value of the chargeback

  • any fees charged by payment providers

  • reasonable administrative and recovery costs


6. Delivery

6.1 Orders will be delivered to the address provided during checkout.

6.2 We aim to dispatch orders promptly, typically within 7 days of order confirmation, unless otherwise stated.

6.3 In all circumstances, products will be dispatched within 30 days of receiving payment unless exceptional circumstances occur.

6.4 Delivery times are estimates and cannot be guaranteed.

6.5 Customers must ensure their delivery information is correct. We are not responsible for delays or losses caused by incorrect addresses.

6.6 Customers should inspect items upon delivery and notify us within 48 hours if goods are damaged, missing, or incorrect.


7. Consumer Cancellation Rights (14 Day Cooling-Off Period)

7.1 If you are purchasing as a consumer, you have the right to cancel your order within 14 days without giving any reason.

7.2 The cancellation period expires 14 days after the day you receive the goods.

7.3 To exercise your right to cancel, you must inform us through a clear statement (for example via email).

7.4 Once cancellation is confirmed, you must return the goods within 14 days.

7.5 Returned goods must be unused and handled only as necessary to establish their nature and function.


8. Returns and Refunds

8.1 If you cancel within the cooling-off period, we will refund:

  • the price paid for the goods

  • the standard delivery cost originally paid

8.2 If you selected a premium delivery option, we may deduct the difference between that service and the cheapest delivery option available.

8.3 Refunds will be issued using the same payment method used for the original purchase unless agreed otherwise.

8.4 Refunds will be processed within 14 days of receiving the returned goods or receiving proof that the goods were sent back.


9. Return Shipping

9.1 Unless the item is faulty or incorrectly supplied, customers are responsible for return postage costs.

9.2 Where we agree to cover or reimburse return postage costs, reimbursement will be limited to the amount originally paid by us to ship the product to you.

9.3 Any return shipping costs exceeding this amount will remain the responsibility of the customer unless otherwise agreed.

10. Faulty or Incorrect Products

10.1 If a product arrives faulty, damaged, or incorrect, please contact us as soon as possible.

10.2 Where a product is confirmed to be faulty or incorrectly supplied, we will offer one of the following remedies in accordance with UK consumer law:

  • replacement

  • repair

  • refund

10.3 In these cases we will also cover reasonable return shipping costs as per 9.2


11. Warranties

11.1 We warrant that:

  • we have the right to sell the products

  • the products will match their description

  • the products will be of satisfactory quality

11.2 Except where required by law, no additional warranties are provided.


12. Limitation of Liability

12.1 Nothing in these terms limits liability for:

  • death or personal injury caused by negligence

  • fraud or fraudulent misrepresentation

  • any liability that cannot be excluded by law

12.2 We are not liable for indirect or consequential losses including:

  • loss of profit

  • loss of business

  • loss of revenue or opportunities

12.3 Our total liability relating to any order will not exceed the total amount paid for the products in that order.


13. Events Outside Our Control

13.1 We will not be liable for failure to perform obligations where the failure is caused by events outside our reasonable control, including:

  • supplier failures

  • strikes

  • power outages

  • natural disasters

  • government restrictions


14. Third Party Rights

14.1 These terms apply only between you and The Racker. No third party has rights to enforce these terms.


15. Entire Agreement

15.1 These terms constitute the entire agreement between you and us regarding the sale of products.


16. Governing Law

16.1 These terms are governed by the laws of England and Wales.

16.2 Any disputes shall be subject to the jurisdiction of the courts of England and Wales.
